By purchasing items from www.worfieldplants.co.uk, you enter a legally binding agreement with Boningale Ltd on the following terms. You should read and understand these terms because they affect your rights and liabilities. These terms describe the basis for purchase by you and sale by us of the products described on this website.

In these Terms, the following words have the following meanings:
“Contract”: The contract for the sale and purchase of the Goods;
“Delivery Area”: At present, this includes most mainland UK addresses, with some exceptions. All non-mainland UK addresses are excluded, e.g.: The Isle of Wight, the Isle of Man, the Scottish Isles, Ireland and the Channel Islands. Please see our Delivery Details page for further information.
“the Website”: Our existence on the world wide web, currently accessible via the address www.worfieldplants.co.uk.
“the Seller”, “we”, or “us”: Worfield Plants (our Company number is 651044 and our registered office is at Boningale Ltd, Holyhead Road, Wolverhampton, WV7 3AT).
“the Customer”: The domestic consumer customer of the Company.
“Goods”: The Goods and/or Services that the Customer agrees to buy from the Company.
1. Basis of the sale
1.1 An agreement for us to sell you Goods is made on these terms when we accept an order made by you via our Website or other methods. The description of the Goods, the prices, the chargeable VAT (when applicable), insurance and delivery costs are set out in the order page. We will confirm acceptance of your order on-screen and via Order confirmation, sent to your provided email address.
1.2 We aim to give you a clear idea of the nature of the plants we sell. However, you appreciate that there are inevitably slight variations in size, shape and colour between different specimens. Illustrations, descriptions and other information concerning supplied goods are approximate and for guidance only. Whenever something isn’t available, we will keep customers informed of any alterations.
2. Details of the order
2.1 The quantity, quality and description of the Goods will be those set out in your order and can be seen on your order confirmation.
2.2 Orders are accepted at our sole discretion, but are normally accepted if: the Goods are available, the order reflects current pricing, you are based in the Delivery Area and your payment card is authorised for the transaction.
2.3 The Goods which can be ordered via our Website are only available for delivery to you if you are based in our Delivery Areas. We currently do not deliver to: The Isle of Wight, the Isle of Man, the Scottish Isles, Ireland and the Channel Islands.
3. Price of the Goods
3.1 At the time of payment being received, the price of Goods is as stated on your order confirmation. The amount you have been invoiced will be the amount you pay. In exceptional circumstances, items may need to be refunded if they cannot be fulfilled at the original confirmed price.
3.2 Our charges for transport, packaging and insurance are detailed on the order page and will be included in the total price for the Goods. Please see our Delivery Details page for current charges. When purchasing items online, Postage and Packaging prices will be added to your basket automatically, depending on your postcode.
3.3 The prices displayed on the website are inclusive of VAT (excepting edibles). We have the right to adjust prices without prior warning, whenever we deem it necessary.
4. Payment terms
4.1 We accept most major credit and debit cards except for American Express.
4.2 We will charge your payment card upon receipt of order. We accept no liability if a delivery is delayed because you the Customer did not give us the right payment details.
4.3 Any data we hold on customers is secure. We will take reasonable care to keep all information connected with your order secure, but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from our Website, unless this is solely due to our negligence.
5. General delivery
5.1 We will deliver the Goods to the address you specify for delivery in your order. It is important that this address is accurate when inputting this information as we will not be liable for delays from failed deliveries nor refund the delivery cost due to an incorrectly typed address. If leaving postal instructions, please be precise about where you would like the Goods left if you are out when we deliver. Our couriers will make every attempt to leave your goods as requested, but during difficult COVID-restricted times, this may not always be possible. We cannot accept any liability for any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions.
5.2 We will aim to deliver within the quoted time frame and we will endeavour to achieve this, though it is not guaranteed. Anticipated delivery timeframes will be stated on relevant product pages. If delivery is delayed due to any cause beyond our control, we will contact you via email to advise you that the delivery date will have to be extended.
5.3 All deliveries are GPS tracked from location to location, so we will have the ability to look into the courier’s delivery route.
5.4 Noted delivery dates on marketing material can change without prior notice and are approximate.
5.5 We reserve the right to delay entire orders containing pre-order items. Where we can fit more items into a single courier delivery, we will endeavour to do so, in the name of sustainability. We will notify you of any changes via email.
5.6 We cannot hold orders. If you cannot accept your order at the anticipated delivery time, you must provide an alternative delivery address for the order to go to at point of purchase.
6. Risk and ownership
6.1 Risk of damage to or loss of the Goods passes to you at the time of delivery to you or, if you fail to take delivery at the agreed time, the time when our couriers tried to deliver.
6.2 You will only own the Goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
7. Promotions
7.1 All of our promotions and offers are repeatable, unless stated otherwise.
7.2 Repeatable means when using a Buy One Get One Free promotion, you could theoretically buy 10 plants and get 10 plants free.
7.3 Discount codes and Worfield promotional vouchers can only be redeemed against plant products, not postage and packaging.
7.4 Worfield Plants promotional vouchers and discount codes can be both multi-use and single-use. We will clearly specify the usage terms in each instance.
7.5 On orders where vouchers and discount codes are applied, all orders are subject to acceptance by Worfield Plants.
7.6 Worfield promotional vouchers and discount codes are non-transferable and are valid for 1 year only from date of issue.
7.7 Worfield Plants reserves the right to remove promotional items from sale with no further notice.
7.8 On multi-buy promotions (for example, 3 for 2 offers), where a product is discounted or free of charge, it is the items with the cheapest retail value that will have the discount applied.

9. Warranties
9.1 We always aim to provide high quality plants and products to our customers. All items are fully inspected and prepared for despatch to customers. Products will meet their specification at the time of despatch.
9.2 Even though we are “Experts” we are not able to guarantee when plants will produce flowers or fruit. We can give you informed estimates but as it’s largely determined by external factors beyond our control, such as the plant’s age, or the availability of water, light and nutrients, this is always an estimate.
9.3 The availability, price and colour of plants we sell to you may vary according to seasonal and market availability. In rare circumstances, we may be unable to fulfil your order. In these unfortunate situations, an alternative plant will be chosen by our expert growers, which will offer a similar aesthetic or higher market value. 10. Liability
10.1 If you have a valid claim in respect of any of Goods, which is based on any defect in their quality or condition, or their failure to meet specification in accordance with the Contract, and you have returned the Goods within 14 days, you will be entitled to choose either a refund equivalent to the price of the Goods (excluding postage) or replacement Goods free of charge.
10.2 We will endeavour to keep the website up to date, but the information and specifications given are for your information only and are subject to change without notice. We make every attempt to ensure they are accurate, however if you notice any mistakes or problems, please let us know via email at contactus@worfield.co.uk.
10.3 Imagery used on the website is as accurate as possible, although due to our goods being living products, they may show variations in colour, shape and size.
10.4 Please note the difference between a partial or full refund: If we issue a partial refund, this will only include the cost of the relevant goods originally paid for (we will not refund the original delivery cost). If we issue a full refund, this will cover the cost of the entire original order (cost of the goods originally paid for plus a refund of the original delivery cost).
11. Matters out of our control
11.1 We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.
11.2 We will not be held responsible for orders arriving at unmanned addresses.
12. Copyright
12.1 All of the website’s content is protected by copyright law. Only Worfield Plants has the right to use any displayed material and we will not accept any liability for those breaching Copyright law whilst accessing our website.
12.2 No Worfield Plants content or material can be used without our written permission. This includes logos, slogans, or other associated phrases.
13. Privacy

We have noted this information on product pages where possible, to inform our customers before they purchase our products. 18. Governing law and jurisdiction
18.1 These terms will be governed by English law and any disputes will be resolved exclusively by the English Courts. They do not affect your statutory rights as a consumer.
